Terms

Once account is approved for open terms, our terms are Net 30 days, however we do offer a 2% discount at 10 days and encourage our customers to take advantage of this. Should an account reach 45 days, our computer will automatically put that account on "Hold" until brought into line. Please note accounts that do not have open terms will not be entitled to the 2% discount.

Prices

|
The SELLER reserves the right to increase prices when increasing costs necessitate an increase in price. Any extraordinary transportation costs and/or insurance Charges are the responsibility of the PURCHASER. On blanket orders the pricing is held for a term of up to 1 year, however may be subject to commodity surcharges. Again Rush Electronics will do all it can to hold contract pricing, but in the event that the price must be increased, the customer will be notified 1 month prior to increase.

Shipping

Method of shipping is to be designated by the SELLER unless specified by the PURCHASER.
|

Delivery
|
| |
|
Unless specified otherwise, delivery is F.O.B. our plant. Although shipping dates are approximate, we will strive to honour them. However, we shall not be held responsible for delay in delivery caused circumstances beyond our control. Wherever possible, Rush is flexible on rescheduling. Allowing customers to push out and pull in delivery dates modifying orders to meet their production needs. However, we do require that product be consumed within 1 year from the date the order was processed.

An order shall be deemed a covenant between PURCHASER and SELLER. Consequently, the SELLER'S consent is required for any cancellation, change to or reduction in the amount of an order. The SELLER may at his discretion levy a cancellation fee. Goods manufactured to the PURCHASER'S specifications cannot be cancelled.

Patents

|
Any expense or loss resulting from the infringement of patents or trademarks arising from compliance with the PURCHASER'S designs, specifications or instructions rests with the PURCHASER.
|
|
Quantity
|
| |
|
All attempts will be made to ship quantities requested by the PURCHASER. Custom parts shipments may deviate by a +/- 10% order quantity variation.

Returned goods policy

Goods will be accepted for return only:

Within a 30 day period from date of shipment

With an authorization number from the SELLER

If the parts are found to deviate from the initial order requirements

Warranty

The PURCHASER acknowledges that it has not relied on the SELLER'S skill or judgment in furnishing goods for any particular purpose and SELLER does not warrant the goods furnish hereunder to be fit for any particular purpose. In particular, where the goods furnished hereunder are only a constituent element or component of a finished product, the SELLER does not warrant the goods finished hereunder to be suitable for such application.

Unless specifically agreed to in writing, the SELLER will not be liable for any incidental or consequential damages, contingent liability, or labour costs, for any cause whatsoever, in respect of standard inventory parts or special parts supplied, and the SELLER'S liability is specifically limited to the purchase price paid by the PURCHASER to the SELLER herein.

Ownership of goods

Title of goods remains with the SELLER until payment is received.

Any purchase order or order with terms or conditions that conflicts with terms outlined above are considered void by RUSH ELECTRONICS LTD.

Rush Electronics has a minimum order of $50.00. Additions to open orders are allowed.

Rush Electronics is an ISO 9001:2000 certified company and takes great pride in our dedication to supplying quality products and services. We encourage and welcome vendor evaluation reports. They are used as an important tool in employee evaluations and allow us to target problem areas and improve customer satisfaction. If you receive incorrect shipments, shortages or any other non-conformances we ask that they be reported to Rush Electronics within 10 days of receipt of product.
